Job Description

Role Summary

The Legal Officer with 5 to 7 years experience should provide comprehensive legal support for all real estate development and construction operations in India, including land acquisition, RERA compliance, project documentation, procurement contracts, customer documentation, and dispute resolution. The role ensures all projects comply with applicable Indian laws and mitigates legal risks for the organization.

2. Key Responsibilities. Land Acquisition & Due Diligence

  • Conduct legal due diligence on land parcels, including:
  • Verification of title documents
  • Encumbrance checks
  • Revenue records (RTC, 7/12 extracts, mutation entries, Khata/Patta, etc. depending on state)
  • Court cases and land disputes
  • Coordinate with government departments (Revenue Office, Tehsildar, Registrar/Sub-Registrar, Town Planning).
  • Prepare and review agreements such as:
  • Sale Deeds
  • Joint Development Agreements (JDA)
  • Power of Attorney (PoA)
  • Development Rights Agreements (DRA)

B. RERA Compliance

  • Draft, review, and file all documentation for RERA registration of projects.
  • Ensure compliance with state-specific RERA norms.
  • Manage quarterly/annual RERA updates, financial disclosures, and customer communication.
  • Support resolution of RERA complaints and hearings.

C. Construction & Procurement Contracts

  • Draft, vet, and negotiate:
  • Contractor agreements
  • Consultant agreements (architects, engineers, PMC)
  • Tender documents and SLAs
  • FIDIC-based contracts (if used)
  • Ensure correct incorporation of timelines, scope, penalties, indemnities, and safety clauses.

D. Sales, Leasing & Customer Documentation

  • Draft and review:
  • Agreement to Sell
  • Sale Deed
  • Allotment Letters
  • Builder-Buyer Agreements
  • Lease Deeds & Leave & License Agreements
  • Ensure compliance with:
  • The Real Estate (Regulation and Development) Act, 2016
  • Indian Registration Act
  • Transfer of Property Act
  • State Apartment Ownership Laws

E. Litigation & Dispute Management

  • Manage litigation related to:
  • Land disputes
  • Consumer complaints (Consumer Commissions)
  • Civil suits (specific performance, injunctions, recovery)
  • Arbitration matters
  • RERA cases
  • Coordinate with external counsel and prepare legal notices, replies, and case briefs.

F. Regulatory & Statutory Compliance

  • Ensure compliance with:
  • RERA
  • Stamp Duty & Registration laws
  • Environmental regulations (MoEF/SEIAA)
  • Municipal bylaws, development control regulations (DCR)
  • Labour, safety, and contract labour laws applicable to construction
  • Liaise with authorities such as Town Planning, Pollution Control Board, Electricity Board, Fire Department, Municipal Corporation, etc.

G. Corporate Legal Support

  • Draft and review board resolutions, NDAs, corporate agreements.
  • Assist in company secretarial activities (if required) including MCA filings and statutory registers.
  • Provide legal opinions to management on project feasibility and risk mitigation.

3. Qualifications & ExperienceEducation

  • Bachelor of Laws (LLB) from a recognized university.
  • Enrollment with State Bar Council.
  • LLM or specialization in Real Estate / Corporate / Property Law is preferred.

Experience

  • 3–7 years in real estate, construction, or infrastructure companies.
  • Strong knowledge of:
  • Land laws
  • RERA
  • Civil law and contract law
  • Registration & stamp duty procedures
  • Consumer and arbitration laws

4. Key Skills Required

  • Excellent drafting and negotiation skills.
  • Strong understanding of the real estate project lifecycle.
  • Ability to manage litigation and coordinate with external advocates.
  • Strong communication and interpersonal skills.
  • High attention to detail and risk-mitigation mindset.
  • Ability to work cross-functionally with sales, projects, finance, and procurement teams.

5. Key Performance Indicators (KPIs)

  • Accuracy and timeliness of contract reviews.
  • Compliance with RERA and statutory deadlines.
  • Reduction in legal disputes/claims.
  • Successful handling of litigation and external counsel coordination.
  • Efficiency in land due diligence and documentation.
  • Internal stakeholder satisfaction.

6. Work Environment

  • Office-based role with regular visits to:
  • Registrar/Sub-Registrar offices
  • Government departments
  • Project sites
  • Courts/tribunals when necessary

Job Types: Full-time, Permanent

Pay: ₹40,000.00 - ₹50,000.00 per month
