Job Description

Key Responsibilities:

1. Legal & Regulatory Advisory

  • Provide legal support to management on all healthcare-related matters.
  • Ensure compliance with healthcare laws:

    Clinical Establishments Act, Drugs & Cosmetics Act, MCI/NMC guidelines, Biomedical Waste Management Rules, NABH/JCI standards

    , etc.
  • Advise on patient rights, medical negligence cases, consent forms, and medico-legal documentation.

2. Contracts & Transactions

  • Draft, review, and negotiate contracts with doctors, consultants, suppliers, insurance companies, TPAs, and vendors.
  • Manage MoUs for clinical collaborations, research tie-ups, empanelment agreements, and outsourcing contracts.
  • Support mergers, acquisitions, or expansions of healthcare facilities.

3. Litigation & Medico-Legal Cases

  • Handle medico-legal cases including patient complaints, malpractice claims, and consumer disputes.
  • Liaise with advocates, hospitals, insurers, and regulatory authorities for dispute resolution.
  • Represent the hospital/organization in court, arbitration, and consumer forums as required.

4. Compliance & Licensing

  • Ensure timely renewal and maintenance of hospital licenses (fire safety, biomedical waste, pollution control, pharmacy, blood bank, etc.).
  • Monitor compliance with labor laws, data protection (especially patient data confidentiality under HIPAA/GDPR equivalent local rules), and clinical trial regulations.
  • Conduct compliance audits and ensure corrective action.

5. Risk Management & Policy Development

  • Draft medico-legal policies, patient consent protocols, grievance redressal procedures, and compliance manuals.
  • Conduct medico-legal awareness training for doctors, nurses, and administrative staff.
  • Anticipate legal risks and develop proactive mitigation strategies.

6. Leadership & Stakeholder Engagement

  • Work closely with hospital management, medical directors, HR, operations, and finance teams.
  • Manage external legal advisors and provide guidance to internal teams.
  • Act as a trusted partner balancing patient care priorities with legal safeguards.

Qualifications & Skills:

  • Education:

    LLB / LLM (specialization in Healthcare Law preferred). PG Diploma in Healthcare & Hospital Law (advantage).
  • Experience:

    812 years of legal experience, with minimum 4–5 years in hospital/healthcare/ pharmaceutical/insurance sector.
  • Expertise in:

    Healthcare regulations, medico-legal case handling, contracts, licensing, compliance frameworks.
  • Skills:

    • Strong medico-legal documentation & contract drafting.
    • Litigation and dispute resolution.
    • Knowledge of patient rights, clinical research regulations, and medical ethics.
    • Excellent communication & stakeholder management.

Key Performance Indicators (KPIs):

  • Zero major legal non-compliances.
  • Timely resolution of medico-legal cases.
  • Smooth contract execution with stakeholders.
  • 100% renewal of healthcare licenses on time.
  • Reduction in litigation exposure and patient grievances.
