Senior-Litigation (Real Estate)

The Legal role is responsible for handling both litigation and non-litigation matters related to land, residential, and commercial real estate projects developed or being developed by the Company in Maharashtra. The position involves end-to-end management of court and tribunal matters, drafting and finalization of legal documentation, coordination with law firms, counsels, and internal departments, and providing legal advisory support for real estate transactions. The role plays a critical part in assessing legal risks, ensuring statutory compliance, and supporting smooth execution and closure of property transactions for the Company.

• Handle litigations relating to land as well as residential and/or commercial real estate projects developed or under development by the Company.
  

• Manage litigation matters related to flats/apartments before Courts, Tribunals, including the Real Estate Regulatory Authority (RERA) and Consumer Forums.
  

• File complaints, written submissions, replies, and appeals before Courts, Tribunals, and quasi-judicial authorities.
  

• Draft and finalize legal documents pertaining to litigation matters.
  

• Coordinate with High Court counsels for effective case management.
  

• Liaise with external law firms and lawyers and ensure internal coordination across departments for litigation and legal matters.
  

• Review and finalize title search reports and title certificates for land and flats.
  

• Draft legal documentation for various real estate projects developed and/or managed by the Company.
  

• Review lease deeds, mortgage documents, trust deeds, and related legal instruments.
  

• Draft Joint Development Agreements (JDAs) along with ancillary documentation.
  

• Support transaction structuring in coordination with finance companies and lenders.
  

• Draft and finalize Agreements for Sale, Sale Deeds, Letters of Allotment, Deeds of Conveyance, and Legal Notices.
  

• Coordinate with municipal authorities and related departments for land acquisition and property-related matters.
  

• Provide legal advice on transactions involving purchase and sale of land and buildings, including agricultural and non-agricultural land.
  

• Provide legal advisory support for transactions relating to flats and apartments.
  

• Assess legal risks associated with transactions and develop appropriate remedial measures.
  

• Address and resolve legal issues prior to transaction closure.
  

• Analyse property documents to identify errors, discrepancies, or potential fraud.
  

• Conduct investigation of property history and zoning compliance.
  

• Prepare closing checklists and assemble all documents required for transaction closure.
  

• Assist in stamp duty calculation, adjudication, and registration of legal documents.
  

• Education:  LLB from a recognized university; LLM will be an added advantage.
  

• Experience:  8+ years of hands-on experience in real estate legal roles involving both litigation and non-litigation matters in Maharashtra.
  

• Mandatory:  Prior law firm experience with strong exposure to real estate matters.
  

• Proven experience in handling litigation related to land, flats, and residential/commercial real estate projects before Courts, Tribunals, RERA, and Consumer Forums.
  

• Strong expertise in non-litigation activities including real estate transaction structuring, title due diligence, drafting and vetting of property-related documents.
  

• In-depth knowledge of property laws, land acquisition laws, stamp duty, adjudication, registration laws, and municipal regulations applicable in Maharashtra.
  

• Experience in drafting and reviewing Agreements for Sale, Sale Deeds, Deeds of Conveyance, Joint Development Agreements (JDAs), lease and mortgage documents, legal notices, and related documentation.
  

• Ability to review title search reports, title certificates, and analyse property documents to identify legal risks, discrepancies, or fraud.
  

• Strong coordination skills to liaise with courts, counsels, law firms, municipal authorities, and internal stakeholders.
  

• Excellent drafting, analytical, negotiation, and communication skills with high attention to detail.
  

• Proficiency in MS Office and legal documentation management.
  

• Fluency in  English  is mandatory; working knowledge of  Marathi  is preferred for dealing with local authorities and documentation.
