Job Description

Key Responsibilities

Legal Documentation & Advisory:

Drafting, reviewing, and negotiating various legal agreements, including loan agreements, vendor contracts, non-disclosure agreements (NDAs), and internal policies.

Providing strategic legal advice to management and different business departments on operations, new products, marketing strategies, and potential legal risks.

Regulatory Compliance & Risk Management:

Ensuring the organization adheres to all applicable laws and regulations, with particular emphasis on RBI guidelines, the Companies Act, the Contract Act, and data protection laws.

Developing and implementing policies to align the company with evolving regulatory requirements, such as KYC/AML compliance and capital adequacy.

Identifying potential legal and regulatory risks in business operations and developing strategies to mitigate them.

Litigation & Dispute Management:

Overseeing and managing the company's litigation portfolio, including civil, criminal, consumer, and arbitration cases.

Developing and implementing effective dispute resolution strategies and coordinating with empanelled external legal counsel.

Handling legal proceedings related to case filings, summons, warrants, and arbitrations.

Recovery & Asset Management (often a specific focus):

Advising the recovery teams on legal procedures for debt recovery and asset possession within legal frameworks.

Handling legal processes under specific acts like the Arbitration and Conciliation Act or the Negotiable Instruments Act (for cheque bounce cases).

Stakeholder Coordination:

Liaising with external legal counsel, regulatory bodies (like the RBI or MCA), and internal cross-functional teams (credit, operations, finance) to ensure smooth operations and timely approvals.

Required Qualifications & Skills

Education: A Bachelor's degree in Law (LLB) is required; a Master's degree (LLM) is often preferred.

Experience: Typically requires 4-5 years of relevant experience, preferably within the NBFC, banking, or financial services sectors.

Knowledge: In-depth knowledge of corporate law, financial regulations, and laws applicable to NBFCs is essential. Practical knowledge of specific recovery mechanisms and court procedures is also valued.

Skills: Excellent legal drafting, negotiation, analytical, and problem-solving skills are crucial for this role.
