Job Title: Legal Counsel Litigation

Location: Mumbai

Experience: 68 years Post Qualification Experience (PQE)

Role Overview

The incumbent will be responsible for managing and overseeing all litigation matters across civil, criminal, and regulatory forums for the NBFC. The role requires strong domain knowledge in recovery and enforcement laws, including SARFAESI, DRT, IBC, Arbitration, and general civil and criminal litigation, with the ability to advise internal stakeholders and coordinate with external counsels to protect the companys legal and commercial interests.

Key Responsibilities

  • Litigation Management:
  • Manage end-to-end litigation, including drafting pleadings, affidavits, replies, rejoinders, and coordinating with external advocates.
  • Represent the company before various judicial and quasi-judicial authorities such as DRT, NCLT, Civil and Criminal Courts, Consumer Forums, and Arbitration Tribunals.
  • Monitor and track progress of ongoing cases, ensuring timely filing, hearings, and compliance with court directions.
  • Legal Strategy & Advisory:
  • Formulate litigation strategy in consultation with senior management and business teams.
  • Provide legal opinions and risk assessment on matters relating to recovery, enforcement, and contractual disputes.
  • Advise business teams on legally sustainable recovery actions, including SARFAESI measures and arbitration proceedings.
  • Documentation & Drafting:
  • Draft, vet, and review notices, replies, agreements, and settlement documents relating to litigation and enforcement actions.
  • Liaise with advocates for preparation of plaints, written statements, and affidavits.
  • Arbitration & Recovery Proceedings:
  • Handle arbitration matters (both initiation and defence) including appointment of arbitrators and execution of awards.
  • Coordinate enforcement under SARFAESI Act and DRT recovery mechanisms.
  • Stakeholder Management:
  • Engage with internal stakeholders (business, collections, operations) to provide timely legal support.
  • Liaise with external law firms, advocates, and enforcement agencies to ensure effective handling of cases.
  • Legal Reporting & MIS:
  • Maintain comprehensive litigation MIS, track case outcomes, and provide periodic updates to management.
  • Analyse litigation trends to identify risk areas and suggest process improvements.

Desired Candidate Profile

  • LL.B. (5-year or 3-year) from a reputed university;
  • 6-8 years of post-qualification experience, ideally with a financial institution, NBFC, or reputed law firm handling banking and finance litigation.
  • Strong understanding of:
  • SARFAESI Act, 2002
  • Recovery of Debts and Bankruptcy Act, 1993 (DRT Act)
  • Insolvency & Bankruptcy Code, 2016 (IBC)
  • Arbitration & Conciliation Act, 1996
  • Civil and Criminal Procedure
  • Excellent drafting, negotiation, and communication skills.
  • Ability to work independently and manage multiple cases under pressure.
  • Proactive, detail-oriented, and collaborative approach to problem solving
