Role Summary

The Legal Counsel Litigation will manage the organizations litigation matters across civil, criminal, and regulatory forums. The role involves providing strategic legal advice on recovery, enforcement, and contractual disputes while coordinating with internal teams and external counsels to protect the organization’s legal and commercial interests. Strong expertise in SARFAESI, DRT, IBC, Arbitration, and general civil and criminal litigation is essential.

Key Responsibilities

Litigation Oversight:

• Handle end-to-end litigation, including drafting pleadings, affidavits, notices, replies, and rejoinders.
  Represent the organization before courts, tribunals, and regulatory forums such as DRT, NCLT, Civil and Criminal Courts, Consumer Fora, and Arbitration Panels. Monitor ongoing cases and ensure timely filings, hearings, and compliance with court directives.

Legal Advisory & Strategy:

• Formulate litigation strategies in consultation with senior management and business teams.
  Provide legal opinions and risk assessments on recovery, enforcement, and dispute matters. Advise teams on legally compliant recovery actions, including SARFAESI measures, arbitration, and other enforcement proceedings.

Drafting & Documentation:

• Draft, review, and vet legal notices, replies, agreements, settlement documents, and other litigation-related paperwork.
  Coordinate with external advocates for preparation of plaints, written statements, and affidavits.

Arbitration & Recovery:

• Manage arbitration matters, including appointment of arbitrators and execution of awards.
  Oversee enforcement under SARFAESI Act and DRT mechanisms.

Stakeholder Coordination:

• Provide timely legal guidance to internal teams such as business, collections, and operations.
  Liaise with external law firms, advocates, and enforcement agencies for effective case handling.

Reporting & Analytics:

• Maintain comprehensive litigation MIS and provide periodic updates to senior management.
  Analyze litigation trends to identify risks and suggest process improvements.

Desired Candidate Profile

- Bachelor of Laws (LL.B.) from a recognized university (3-year or 5-year program).
- 6–8 years of post-qualification experience, preferably in a financial institution, NBFC, or law firm with exposure to banking and finance litigation.

• Strong knowledge of:

  SARFAESI Act, 2002 Recovery of Debts and Bankruptcy Act, 1993 (DRT Act) Insolvency & Bankruptcy Code, 2016 (IBC) Arbitration & Conciliation Act, 1996 Civil and Criminal Procedure
• Excellent drafting, negotiation, and communication skills.
  
• Ability to manage multiple cases independently under pressure.
  
• Proactive, detail-oriented, and collaborative approach to problem solving.
