Roles and Responsibilities

Position/Role: Legal Head

Experience: 15 to 20 yrs. (preferably from top 10 law colleges)

Qualification: LLB

Salary Range: As per Industry Standards

Job Location: Corporate Office

Roles & Responsibilities:

• Title due diligence, title search of the Property. Ensuring Mortgage transactions Balance transfer, Resale, etc.
• Possess expert knowledge of property law (including registration and stamp duty laws, RERA), Land Acquisition, Criminal and Civil law (both substantive and procedural), Consumer Protection law, Evidence law, Negotiable Instruments Act & good working knowledge of Law.
• Expertise in Vetting, Due diligence and Drafting (Contracts, Pleadings, Conveyance Deeds and Court Proceedings, Legal notices and reply to the same, and replies to be filed for the grievances etc).
• Exposure on Real estate Laws, RERA act, Registration act etc.,
• Strong record of facilitating resolution of legal matters with effective pleadings, presentation of evidence and persuasive argumentation. Adept in settling disputes through alternate dispute resolution mechanisms including Mediation, Arbitration etc.
• Wide experience of the various District courts, Forums, Tribunals, and High Court to settle the litigations.
• Land acquisition, Vetting and Due Diligence, Preparation of Title Search Report/Legal opinion of the Properties/Lands, collation of documents of the Property to be acquired etc, suggesting the plan of action for acquisition of Lands/Properties, Litigation of Civil and Criminal cases including cheque bounch cases and recovery of Money, Property related Civil Suits, Real Estate Regulation and Development Act (RERA), Arbitration Act, Pursuing of cases/suits filed by the Company and against the Company and collation of documents and records which are required/needed for the cases/suits, briefing of Advoacates for the necessary course of action to be taken. Drafting of Petitions, Written statements, Plaints, Affidavits, Counters, Complaints, Legal Notice , Reply Notices and other as per the requirement of the cases/suits. Appearing before Courts and representing on behalf of the Company in the cases/suits and follow with the Advocates for the proper adjudication of the cases/suits.
• Drafting Contracts i.e Agreement of Sale as per RERA format , Sale Deeds, Lease Deeds of Commerical space of the Company, AGPA, GPA, MOU, DAGPA, Tripartite Agreements of Banks & other, Supplementary Agreements, Amendment Agreements, Booking forms, Disclaimers, and other Deeds and Agreements as required for Company
• Implement MIS for Litigation, Agreements, and Compliances and ensure record keeping of litigation files and site folders.
• Draft and review contracts, agreements and internal policies and ensure that they are in compliance with all statutory or legal requirements.
• Reviewing and advising the management on legal implications of internal policies and procedures.
• Coordinating with statutory authorities, regulatory bodies and other Government agencies to ensure the completion of all legal documents and process requirements.
