Vice President Legal Collections

Roles & Responsibilities

• Manage and oversee all litigation activities related to the recovery of dues, including filing cases against defaulting customers and handling Non-Performing Asset (NPA) portfolios.

• Possess in-depth knowledge of and handle cases proficiently under the Insolvency and Bankruptcy Code (IBC), SARFAESI Act, Arbitration and Conciliation Act, and Section 138 of the Negotiable Instruments Act.

• Draft, review, and issue legal notices, replies to notices, and other legal documents with precision and adherence to legal standards.

• Appear in court for hearings and manage the day-to-day progression of legal proceedings.

• Execution of BW / NBW through police in cases u/s 138 of NI Act,

• Coordinate and supervise the end-to-end SARFAESI process, including issuing demand and possession notices, taking symbolic/physical possession, and managing property auctions.

• Act as the primary point of contact for external legal counsel and arbitrators, managing interactions and ensuring effective representation for the company.

• Conduct site visits as required for the execution of SARFAESI actions and other legal enforcement activities.

• Maintain comprehensive and organized records of all legal cases, documentation, and correspondence to ensure audit readiness and compliance.

• Provide legal advisory support to internal collections teams to ensure all recovery strategies are compliant with current laws and regulations.

• Monitor changes in relevant laws and regulations to keep the organization's legal collection practices current and effective.

• Prepare and present periodic reports on litigation status, recovery progress, and legal risks for senior management review.

Preferred Candidate Profile

• Education: Graduate in Law (LLB) is mandatory.

• Experience: A minimum of 5-10 years of hands-on experience in legal collections and litigation management. Must have direct experience handling NPA cases, SARFAESI proceedings, and IBC-related matters within an NBFC, bank, or other financial institution.

• Strong practical knowledge of civil and criminal procedures related to financial recovery.

• Excellent communication, negotiation, and coordination skills.

• Proven ability to manage multiple stakeholders, including external lawyers, regulatory authorities, and internal teams.
