Job Description

Role & responsibilities

Function objective Drive commercial function for the Middle East Africa (MEA) Region

  • Have the lead for all commercial matters pertaining customer orders into Region MEA routed through Company.
  • Assure the fulfilment of Companys Operational Risk Management Directive, Compliance and any other guidelines related to customer orders.

Main tasks

Contract Management

  • Ensuring the commercial management of customer orders in the Region.
  • Support of the sales team in all commercial matters

• Management of commercial customer and supplier negotiations and interventions in contract disputes.

  • Assure the fulfilment of Operational Risk Management Directive (ORM), Compliance and any other internal and external rules.
  • Development of Non-Disclosure Agreements, Agency Agreement, framework contracts and other contracts in third collaboration with specialist departments and/or external lawyers.

• Support Fulfilment and Finance Department in project controlling, accounts receivable, contract and claim management.

Trade Finance

  • Independently handle Merchanting Trade Transactions (MTT) as well as Project Export Applications (PEM) incl. bank reporting
  • Develop monitoring concept with related departments (e.g. Accounting, Project Management, Logistics)

• Handle daily trade finance matters (LC/guarantees, other payment securities, import licenses) such as application, request, negotiation, amendments, execution

  • Ensure compliance of invoices with LCs and contract
  • Risk mitigation where appropriate with ECA cover (e.g. ECGC)

• Ensure timely processing and monitoring of international payment transactions in foreign trade

  • Ensure adherence to group guidelines as well as local Indian regulatory framework (RBI) for preparation, application timelines and documentation

Treasury

  • Manage FX exposure through hedging activities in collaboration with Corporate Treasury (inflow /outflows Intercompany) as well as project inflows/outflows with local Indian banks
  • Responsibilities/ authority

  • Assure the fulfilment of ORMDirective, Compliance and any other internal rules and laws in all business. • Be actively and early involved in sales & quotation activities • Positively represent the company with all external/internal stakeholders.
  • Main internal Interfaces

  • Internal business partners: Regional Sales representatives (Middel East and Africa), Quotation Teams, Supply Chain Management, Project Managers, Project Controller, Corporate Treasury in Switzerland, Financial Services in Switzerland, Head of Commercial departments in the Region, Department Heads & Finance Managers of the Middel East Africa and India Region
  • • External business partners: Customers, Banks, ECAs (Export Credit Agencies), Agents, Tax advisors

Preferred candidate profile

Masters degree in business / economics / finance / law or similar education • Minimum 8-15 years Experience in Commercial, Foreign Trade Transactions, FEMA /Trade Finance function / Project Finance function / Commercial Management function with international and Cross-Trade Export experience • Tools: Microsoft Office, SAP
