Role Description

The Advocate (PQE-5) role is a full-time, on-site position based in Delhi, India. The Advocate will be primarily engaged in matters under the Insolvency and Bankruptcy Code, 2016 (IBC), with regular appearances before the Hon’ble National Company Law Tribunal (NCLT), the National Company Law Appellate Tribunal (NCLAT), and related forums. The role involves advising and representing financial creditors, operational creditors, corporate debtors, resolution professionals, and other stakeholders in all stages of the corporate insolvency resolution process (CIRP) and liquidation proceedings.


The Advocate will be responsible for drafting and filing applications under Sections 7, 9, 10, and other provisions of the IBC, contesting avoidance and preferential transaction claims, handling applications under Section 66 for fraudulent/wrongful trading, and advising on resolution plans, restructuring strategies, and settlement frameworks. The role also requires coordinating with insolvency professionals, monitoring Committee of Creditors (CoC) processes, and advising on the interplay between IBC proceedings and parallel actions under SARFAESI, PMLA, Arbitration, and other regulatory regimes.


In addition, the Advocate will conduct detailed legal research on evolving jurisprudence in insolvency law, assist in negotiations and settlements in pre- and post-admission stages, prepare comprehensive legal opinions, and ensure compliance with statutory timelines and procedural requirements unique to IBC proceedings. The position demands strong litigation skills, commercial awareness, and the ability to provide practical and effective solutions in high-stake insolvency and restructuring matters.


Qualifications


  • Strong advocacy and litigation skills with demonstrated experience before NCLT, High Courts, and other tribunals
  • Proven expertise in insolvency law (IBC), commercial law, corporate disputes, and allied regulatory frameworks
  • Excellent legal research and drafting skills, including preparation of petitions, replies, rejoinders, legal opinions, and transaction-related documents
  • Developed client counseling and negotiation skills with ability to manage high-stakes matters independently
  • Strong analytical and problem-solving abilities, with capacity to handle complex multi-party disputes
  • Excellent verbal and written communication skills, with clarity and precision in court submissions and advisory work
  • Ability to work effectively in a team environment while managing individual matters independently
  • Bachelor’s degree in Law (LL.B) from a recognized university; LL.M. or additional specialization preferred but not mandatory
  • Minimum of 5 years’ post-qualification experience (PQE) in litigation and corporate advisory
  • Enrolled with the Bar Council of Delhi and authorized to practice law in India
