Job Description

-: JOB PURPOSE :-

  • Responsible for managing the bank's legal recovery actions through the Insolvency and Bankruptcy Code (IBC) and Debt Recovery Tribunals (DRT).
  • The role includes initiating, following up, and coordinating with legal counsels, Resolution Professionals (RPs), and regulatory bodies to ensure timely and effective recovery of non-performing assets (NPAs).
  • To manage and handle all legal matters related to the Insolvency and Bankruptcy Code (IBC), including initiating or responding to insolvency proceedings, ensuring compliance, recovering dues through IBC mechanisms, and representing the Bank before NCLT/NCLAT.

-: KEY RESPONSIBILITIES :-

IBC (Insolvency and Bankruptcy Code) :-

  • Identify suitable cases for initiating action under IBC.
  • File applications under Section 7 of IBC before NCLT (National Company Law Tribunal).
  • Coordinate with legal counsel and Resolution Professionals (RPs) throughout the CIRP (Corporate Insolvency Resolution Process).
  • Monitor timelines under IBC and ensure compliance with IBBI guidelines.
  • Participate in Committee of Creditors (CoC) meetings and vote on resolution plans.
  • Analyze viability and feasibility of resolution plans submitted by bidders.
  • Coordinate with stakeholders to implement approved resolution plans.

DRT (Debt Recovery Tribunal) :-

  • File Original Applications (OA) and follow up on recovery proceedings under RDDBFI Act.
  • Represent the bank in DRT/DRAT (Debt Recovery Appellate Tribunal) cases.
  • Work closely with advocates and banks empanelled legal counsel.
  • Monitor case progress and ensure timely execution of recovery certificates.
  • Assist in attachment and auction of secured assets under SARFAESI/DRT orders.

Documentation & Process :-

  • Draft, review, and file legal pleadings, affidavits, and applications under IBC.
  • Maintain updated records of all insolvency-related cases and track progress.
  • Assist in preparation of resolution plans and voting on CoC (Committee of Creditors) matters.

Liaison & Representation :-

  • Represent the bank in NCLT, NCLAT, DRT, and other forums.
  • Coordinate with external advocates, IRPs/RPs, valuers, forensic auditors, etc.
  • Work with internal stakeholders (Credit, Recovery, Risk) to build IBC strategies.

-: QUALIFICATIONS & EXPERIENCE :-

  • Education: LLB with specialization or certification in IBC or Insolvency Law.
  • Experience: 35 years in banking/NBFC/legal firm handling IBC cases.

-: KEY SKILLS :-

  • Strong knowledge of IBC, Companies Act, DRT, SARFAESI, and related laws.
  • Familiarity with NCLT, DRT procedures, and Court filing systems.
  • Strong legal drafting and interpretation skills, litigation coordination, and case management.
  • Analytical mindset for resolution evaluation and claim verification.
  • Good communication & negotiation skills - verbal / written.
  • Coordination and communication skills for dealing with Advocates, Sr. Counsels, RPs, Liquidators, Govt. / Semi. Govt. Authorities and internal stake holders
  • Team working, coaching, guiding and mentoring skills.
  • Ability to respond immediately with a solution to a situation which is ideal.
