Job Description

A. Organization Context Position: Senior Executive -Legal & Compliance Department : Legal & Compliance Location: Pune, Mumbai B. Job Objective To proactively handle the legal matters for the ACG Group C. Primary responsibilitie s Provide legal support on contractual matters, particularly relating to property mattes, Proactively identify and manage areas of legal risk, particularly relating to property; Conduct property due diligence; Draft and issue legal notices & communication to defaulting companies from time to time. Briefing the solicitors/ senior counsels on various legal litigation matters Initiate, manage and defend civil& criminal litigation at all levels viz: Trial/District courts to High Court/Supreme Court both original and appellate side and provide updates on a regular basis; Represent the company before various civil & criminal courts/judicial forums; Prepare court papers viz petitions, applications, affidavits, written statements, submissions, replies, consent terms etc in a timely manner; Liasoning with govt. bodies, statutory authorities, Litigation Magt; Scrutinizing the documents and evaluate the strength and weaknesses of any prospective litigation and advise; Keeping track of the latest changes in laws having direct bearing on day to day functioning of the company ; Devise and lead the implementation of legal policies and processes which align to both Group and country specific regulations so that both trade legally and are compliant with Group policies and processes. MIS D. Key Result Areas Fair knowledge of commercial laws, business laws, and land laws applicable in Maharashtra including but not limited to CPC, CrPC, The Indian Contract Act, 1872 The Indian Evidence Act, 1872 The Transfer of Property Act, 1882 Power of Attorney Act, 1882 The Indian Easements Act, 1882 The Land Acquisition Act, 1894 The Indian Stamp Act, 1899; The Co-operative Societies Act, 1912 The Wealth Tax Act, 1957 Income Tax Act, 1961 The Specific Relief Act ,1963 The Consumer Protection Act, 1986 The Arbitration & Conciliation Act, 1996 The Multi-State Co-operative Societies Act, 2002 The Registration Act, 1908; The Maharashtra Land Revenue Code 1966; Maharashtra Regional And Town Planning Act, 1966; Bombay Tenancy And Agricultural Lands Act, 1948 and its rules; Hindu Succession Act,1956, The Environmental Laws E. Key Interfaces Internal Interfaces External Interfaces All relevant stakeholders Legal Consultants F. Competency Technical Competency Leadership Competency - L Compassl 1. Practical knowledge of laws relating to real estate; contract act and other commercial laws 2.
