Litigations:
• Analyzing & reviewing various loan documents preparing strategy for initiation of legal proceeding on Borrower.
• Looking after the litigations initiated in the secured portfolio throughout India including SARFAESI proceedings, Sec. 138 proceedings under the NI Act and proceedings under Arbitration & Conciliation Act.
• Responsible for filing of Sec. 14 applications before the CMM/DM for accounts, attending the Court for verifications and liasoning with police officials for taking physical possessions.
• Dealing with the NCLT proceedings, attending COC meetings, filing of applications before the NCLT and invocation of Personal Guarantee for recovery of the outstanding amount.
• Drafting of various legal documents including but not limited to demand notices, reply notices, Private Treaty Agreements, Personal Guarantee Invocation notices, MOUs and notices issued under SARFAESI proceedings.
• Conducting research on latest developments in the Legal domain and preparing the writeup for Legal Knowledge Compendium shared with all the employees.
• Dealing with cases filed against the Company including Civil suits, DRT Proceedings and Writ Petitions. Includes maintaining data for open and closed cases.
• Maintaining MIS of PAN India Litigations and providing the data of legal initiations and cases filed against the company for RBI Compliance.
• Knowledge of Contracts, Transfer of Property Act, Registration Act, Companies Act, RBI guidelines.
• Knowledge of Land laws, RERA, Stamp Act, Contract Act, Transfer of Property Act etc.
• Empanel of various legal counsel for litigation matter, appearing on behalf of Lender in various court PAN India for matter.
