Job Description

Head of Legal, Real Estate Development

Key Responsibilities

  • RERA Compliance:

    Ensure strict adherence to the Real Estate (Regulation and Development) Act, 2016 (RERA). This includes securing all necessary approvals, managing HRERA-approved transfers, and maintaining legal compliance for all project phases.
  • Strategic Advisory:

    Provide comprehensive and proactive legal counsel to the management, promoters, and cross-functional teams (e.g., Finance, Construction, Sales) on all legal and regulatory matters affecting the company and the project.
  • Risk Management:

    Identify, assess, and mitigate all legal and regulatory risks associated with the project's development, financing, sales, and operations.

Contracts & Documentation

  • Drafting and Negotiation:

    Draft, review, and negotiate all high-value and complex legal documents, including:
    • Construction, EPC, and contractor agreements related to the development of the remaining

      6 Towers

      to be built, in addition to the

      4 already built

      towers.
    • Agreements for the purchase of materials, equipment, and services.
    • Sales, allotment, and conveyance deeds for the

      456 residential units

      (including

      8 Penthouses

      ).
    • Financing and investment documentation, especially concerning the new funding and diluted promoter stakes.
  • Title and Due Diligence:

    Oversee and conduct legal due diligence, title verification, and all necessary documentation for the project's

    21 acres

    of land in

    Sector 30, Panchkula

    .

Litigation & Dispute Resolution

  • Dispute Management:

    Effectively handle and manage all litigation, arbitration, and legal disputes, including consumer complaints, title suits, and construction claims.
  • External Counsel Management:

    Liaise with, appoint, and manage external legal counsel to ensure cost-effective and successful representation.

Corporate Governance

  • Ensure that the current organisation adheres to all statutory requirements, corporate resolutions, and internal governance policies.

Required Qualifications & Skills

  • Degree:

    A Law Degree (

    LL.B.

    or equivalent) from an accredited university. A Master's degree (

    LL.M.

    ) or equivalent postgraduate qualification is desirable.
  • License:

    Must be a licensed legal practitioner in India.
  • Experience:

    A minimum of

    10-15 years

    of progressive experience in legal practice, with at least

    5 years

    in a senior legal management or Head of Legal role within a reputable

    real estate development company

    or a law firm specializing in real estate.
  • Real Estate Law Expertise:

    In-depth, proven knowledge of real estate laws, including RERA, Transfer of Property Act, Contract Law, Land Acquisition, and local regulations in

    Haryana

    is essential.
