DUTIES AND RESPONSIBILITIES. 1. Contract administration a. Compile the key contractual specifications/requirements of various projects considering FIDIC/ Signed Contract Agreement; b. Responsible for monitoring and administration of entire contracting process; c. Liaison with Head Ports Division, Site Project Manager, specific consultants, contractors and other related agencies for smooth contract administration; d. Provide assistance to the implementation and management team on various issues of contract administration; e. Notifying and recording delay events; and monitoring of timely correspondence with all stakeholders. f. Review of Change of Scope (COS), Extension of Time (EoT) application and Cost Claims etc if any. 2. Documentation and report preparation a. Ensure that clear and accurate records of contractual matters are maintained at site to monitor key dates, against the dates defined in the main contract and any subcontracts; b. Review Monthly project progress reports in terms of Contractual & financial targets and physical work completion; 3. Adhere to compliance a. Develop and implement systems for internal control that would ensure compliance with SOP, contractual terms and conditions, in collaboration with the technical team at site; b. Ensure the quality implementation of contract precisely in accordance with the contract specifications; QAP. c. Responsible for ensuring compliance with Contractual Terms & Conditions and its implementation to safeguard the interest of the Company. 4. Prepare letters and internal memos a. Review various official letters on the contractual matters that arises in the project life cycle; b. Review internal notices on the hindrances encountered during execution of contracts. c. Maintenance of Records, documents and evidences for Adjudication & Arbitration if arises. 5. Monitoring and supervision a. Analyze and recommend changes to contracts and prepare necessary amendments in contract document; b. Verify project correspondences and advise on problem areas along with identification of any changes/additions/deletions to the contract; c. Handle disputes and claims during the execution of contracts; d. Ensure entire expense is claimed. 6. Communication and coordination a. Provide general advice and assistance to Site Contract Manager, Project Team on contractual matters as required; b. Interact and communicate effectively with corporate contracts team, project team, consultants, contractors, etc.; c. Communicate all contractual issues at meetings; 7. Correspondence with sub-contractors, suppliers, services: a. Timely notices to sub-cons & suppliers b. Preparation of Sub-Con agreements, JVs, MOUs, W.Os etc. c. Preparation of Milestone schedules for sub-cons/suppliers/services etc. B. AUTHORITY Functional and administrative authority for the following decisions in consultation with Head-Contracts-C.O.: 1) All Project related issues with respect to the Cost and Time impact in the Projects. 2) Changes of scope. 3) EOTs, 4) Escalations, 5) Dispute Review Board 6) Mitigation Strategies Experience in Port projects is preferred Knowledge: Well conversant with EPC, HAM, BOT model contracts, FIDIC, Dispute Resolution process including the Arbitration process, Legal process of converting Arbitration awards to Amounts. Skills: Managerial, People Management, Communication and interpersonal skills, Negotiation, Collaboration, Business Acumen, language proficiency
